These Terms of Service ("Terms") govern your access to and use of SawellEcho at https://sawellecho.com and related applications (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Accounts

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at support@sawellecho.com if you suspect unauthorized access.

3. Connected Social Accounts

The Service integrates with third-party social platforms through their official APIs. Your use of those platforms remains subject to each platform's terms and policies. You grant us permission to access and process data from connected accounts solely to provide features you request (publishing, analytics, engagement, monitoring, and automation).

You must only connect accounts you own or are authorized to manage.

4. Acceptable Use

You agree not to:

Violate any law or third-party rights
Post spam, malware, hate speech, or unlawful content
Attempt to bypass rate limits, security, or API restrictions
Reverse engineer or scrape the Service except as permitted by law
Resell or sublicense the Service without written permission
Use the Service to harass, defraud, or impersonate others

5. Content

You retain ownership of content you submit. You grant us a worldwide, non-exclusive license to host, process, transmit, and display your content solely to operate and improve the Service.

You are solely responsible for content published through your connected accounts, including compliance with advertising disclosure rules and platform community guidelines.

6. Subscriptions and Payment

Paid plans, trials, and usage limits are described on our pricing pages. Fees are billed in advance unless stated otherwise. Taxes may apply. Refunds are handled according to the plan terms displayed at purchase and applicable law.

7. Intellectual Property

SawellEcho, our logos, software, and documentation are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or brand except as needed to use the Service.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION OR SPECIFIC RESULTS FROM SOCIAL PLATFORMS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR USD $100 IF YOU HAVE NOT PAID FEES).

10. Indemnification

You will defend and indemnify us against claims arising from your content, your use of the Service, or your violation of these Terms or applicable law.

11. Suspension and Termination

We may suspend or terminate access if you breach these Terms, pose a security risk, or as required by law. You may stop using the Service at any time. Provisions that by nature should survive termination will survive.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory local law applies. Disputes will be resolved in the courts located in Delaware, unless otherwise required by applicable consumer protection law.

13. Changes

We may modify these Terms. Continued use after the effective date of updated Terms constitutes acceptance. If you do not agree, you must stop using the Service.
